Ian Perks Estate Agent is committed to protecting your privacy. This policy should be read with any other privacy or fair-processing notice supplied when personal information is collected.

Information we collect

Personal information is information that can identify an individual. It does not include information where the identity has been removed.

We may receive information from payment providers, property portals and public sources. The established policy names Paymentsense, Rightmove, Zoopla, OnTheMarket, Companies House and the Electoral Register among those sources.

How we use personal information

We use personal information only where the law permits. The main legal bases are performing a contract, meeting a legal obligation, pursuing legitimate business interests where your rights do not override them, and consent where consent is required.

Marketing choices

You can ask us or a third party to stop sending marketing at any time by using an opt-out link or contacting us. Opting out of marketing does not prevent us using personal information to provide a requested service or comply with law. We obtain express consent before sharing personal information with another organisation for its own direct marketing.

Who we may share information with

We may share information where needed with service providers supporting IT, administration, payments, anti-money-laundering checks or tenancy-deposit work; professional advisers; advertising and social-media providers where applicable; HM Revenue & Customs, regulators and other authorities; and a buyer or successor if the business is sold, transferred or merged.

Anti-money-laundering checks

Estate agents must meet obligations under legislation including the Proceeds of Crime Act 2002, Money Laundering Regulations 2017, Bribery Act 2010 and Terrorism Act 2000. We may use electronic identity or credit-reference services and may disclose information to the National Crime Agency or another authority where required. HM Revenue & Customs supervises estate agents for anti-money-laundering compliance. Relevant identity evidence may be retained for seven years.

We require organisations handling personal information for us to protect it and use it only for the agreed purpose.

Information security

We use appropriate measures designed to prevent personal information being accidentally lost, used, accessed, altered or disclosed without authority. Access is limited to people and providers with a business need, who must handle the information confidentially. We also maintain procedures for suspected personal-data breaches and notify regulators or individuals where the law requires it.

How long we keep information

We keep personal information only as long as reasonably necessary for the purpose for which it was collected, including legal, regulatory, tax, accounting and reporting requirements. The established policy states that relevant customer information is normally retained for at least seven years. We may retain it longer if a complaint or legal claim is reasonably possible. Information may be anonymised so that it can no longer identify you and then used for research or statistics.

Your legal rights

Depending on the circumstances, you may have the right to:

  • request access to your personal information and information about how it is used;
  • request correction of incomplete or inaccurate information;
  • request erasure where there is no good reason for continued processing;
  • object to processing based on legitimate interests or for direct marketing;
  • request restriction of processing;
  • request transfer of certain information to you or another organisation;
  • withdraw consent at any time where processing relies on consent; and
  • ask not to be subject to a decision based solely on automated processing where the law provides that right.

To exercise a right, contact the Data Protection Officer using the details above. We may ask for information to confirm your identity and clarify the request. We normally respond within one month. Complex or repeated requests can take longer, in which case we will explain why. Requests are normally free, although the law permits a reasonable fee or refusal where a request is clearly unfounded or excessive.

You may also complain to the Information Commissioner’s Office, although we would appreciate the opportunity to address your concern first.
